Terms of Service

Introduction

Welcome to Automagma. These Terms of Service ("Terms") govern your access to and use of our vehicle marketplace platform, including our website, mobile applications, and all related services (collectively, the "Services").

By accessing or using Automagma, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our Services.

Acceptance of Terms

By using Automagma, you confirm that:

• You are at least 18 years old and have the legal capacity to enter into contracts
• You will provide accurate and complete information during registration
• You will comply with all applicable laws and regulations in Pakistan
• You have read and understood these Terms and our Privacy Policy

Account Registration & Types

Account Creation

To use certain features, you must create an account. You can register using email/password or Google Sign-In. You must:

• Provide accurate, current, and complete information
• Verify your email address by clicking the confirmation link
• Verify your phone number via WhatsApp OTP to unlock contact features
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access

Account Types

Account Status & Verification

• Email Verified: Grants read-only access (browse, search, view listings)
• Active Account: Phone verified users can post listings, purchase Zaps, and use wallet features
• Phone Verified: Required to send messages, view seller phone numbers, and make offers
• We reserve the right to suspend or ban accounts for violations of these Terms

User Conduct & Prohibited Activities

You agree NOT to:

• Post false, misleading, or fraudulent listings
• Use stock photos or images that don't belong to you
• Post duplicate listings for the same vehicle
• Include promotional content unrelated to the specific vehicle being advertised
• Manipulate pricing or engage in price gouging
• Harass, threaten, or abuse other users through messaging
• Share OTPs, passwords, or account credentials with others
• Scrape, copy, or extract data from the platform using automated tools
• Impersonate other users, dealerships, or Automagma staff
• Circumvent security measures or attempt unauthorized access
• Post content that is illegal, obscene, defamatory, or violates intellectual property rights
• Use the platform for money laundering, fraud, or other illegal activities

Listing Rules & Guidelines

Creating Listings

When posting a used car listing, you must:

• Provide accurate vehicle information (make, model, year, mileage, condition)
• Upload real, unedited photos of the actual vehicle (minimum 3, maximum 10 images)
• Set a realistic price based on current market conditions
• Disclose any known defects, accidents, or mechanical issues
• Ensure you have legal ownership or authorization to sell the vehicle

Listing Moderation

• All listings start in "Pending Approval" status and are reviewed by our team
• We reserve the right to reject, remove, or suspend listings that violate these Terms
• Listings expire after 60 days and must be renewed using Zaps
• You can edit or delete your active listings at any time

Featured Listings

Featured listings appear at the top of search results and on the homepage. Featured status costs 400 Zaps and lasts for 30 days. Featured listings receive higher visibility but must comply with all listing rules.

Zaps (Platform Currency)

What are Zaps?

Zaps are Automagma's virtual currency used to pay for platform services. Zaps cannot be transferred between users or converted back to real money.

Zaps Pricing

• Listing Creation: 200 Zaps per new listing
• Listing Renewal: 200 Zaps to extend expired listing by 60 days
• Featured Listing: 400 Zaps for 30-day premium placement

Purchasing Zaps

Zaps can be purchased via bank transfer using pre-defined packages. Payment instructions are provided after package selection. All sales are final — Zaps purchases are non-refundable except in cases of technical error or duplicate charges.

Vouchers

Automagma may issue promotional voucher codes that can be redeemed for free Zaps. Vouchers are non-transferable, have expiration dates, and cannot be combined with other offers unless specified.

Payments & Transactions

Platform Fees

Automagma charges fees in Zaps for listing creation, renewal, and featured placement. Prices are displayed before purchase and may change with prior notice.

Vehicle Transactions

• Automagma is a marketplace platform — we do NOT handle vehicle sales or payments
• Buyers and sellers are responsible for negotiating prices and payment terms directly
• We strongly recommend meeting in person, inspecting vehicles, and verifying documents before payment
• Complete ownership transfers at the relevant excise and taxation office
• Never pay in advance without inspecting the vehicle

Refunds

• Zaps purchases are non-refundable
• Zaps deducted for rejected listings are NOT refunded
• Technical errors resulting in duplicate charges will be refunded within 7-10 business days
• We do not refund Zaps if you are unable to sell your vehicle

In-App Messaging

Automagma provides real-time messaging via SignalR for buyers and sellers to communicate. To access messaging features:

• You must have a phone-verified account
• Messages are stored on our servers and may be reviewed for safety and moderation
• Do NOT share personal banking details, OTPs, or passwords via messages
• Report suspicious or abusive conversations immediately
• We reserve the right to suspend messaging privileges for policy violations

Note: Seller phone numbers are only revealed to phone-verified users after mutual consent via in-app messaging.

Intellectual Property Rights

Our Content

The Automagma platform, including its design, logo, branding, code, and content (blogs, guides, new car data), is owned by Automagma and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute our content without written permission.

Your Content

By posting listings, photos, or other content, you grant Automagma a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the platform and in promotional materials. You retain ownership of your content and are responsible for ensuring you have the right to post it.

Disclaimers & Limitation of Liability

Platform "As Is"

Automagma is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or that the platform will meet your specific requirements.

User-Generated Content

We do not verify the accuracy of user listings, vehicle conditions, or seller claims. Users are responsible for conducting their own due diligence before purchasing vehicles. We are not liable for disputes between buyers and sellers.

Limitation of Liability

To the maximum extent permitted by law, Automagma shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, including lost profits, data loss, or vehicle transaction disputes. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Automagma, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: (1) your use of the platform, (2) your listings or content, (3) your violation of these Terms, or (4) your violation of any third-party rights.

Dispute Resolution

If you have a dispute with another user (buyer or seller), you agree to resolve it directly with that user. Automagma is not responsible for mediating disputes between users.

Any disputes between you and Automagma shall be governed by the laws of Pakistan and resolved in the courts of [Your City], Pakistan.

Account Termination

Termination by You

You may delete your account at any time through account settings. Upon deletion, your active listings will be removed, and your Zaps balance will be forfeited (no refund). Backup data may be retained for up to 90 days.

Termination by Us

We reserve the right to suspend or permanently ban your account without notice if you violate these Terms, engage in fraudulent activity, or pose a risk to the platform or other users. Banned users forfeit their Zaps balance and lose access to all platform features.

Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via email or platform notification. The "Last Updated" date indicates when the Terms were last revised. Continued use of Automagma after changes constitutes acceptance of the updated Terms.
